DEAR SIRS, 
4, hereby authorize you to instruct your Constituents in Enrope to purchase 
and ship’on account and risk per canal Steamers, if possible, the whole' or 
any part of the undermentioned goods upon the terms stated b.elow: 
It shall be optional for your friends to execute and, ship the whole or any 
part of this Order. 
If any dispnte or admitted claim arises with regard to this Order, two 
European Merchants in Bombay (one to be appointed by each of us) to be 
nominal,ed to surveythe goods and the point in dispute, to make any allowances,- 
if need be, as they think fit, and decide final]y in reference thereto. Should the, 
two Gentlemen called not be able to agree in their decision they will choose a 
third party, whose decision shall be final, and hereby agree to abide by it. 
Expenses of survey to be borne by the losing party. 
AU disputes to be settled within one month after the arrival of Steamer, 
Any dispute not then settled to be' considered withdrawn, and no claim to be 
afterwards admitted. If an Order consists of several shipments, each shipment 
shall in respect of any dispute or claim be taken as a separate order. A first 
shipment being late or not shipped shall therefore not entitle “ to refuse any 
of the following ones. , ■ 
Each Shipment is a separate contract. Any complaint of whatever nature; 
to be submitted in writing within 14 days after the arrival of the shipment. 
TERMS OF PAYMENT. — 4, authorize you, or your friends to draw 
upon for account and risk for the total amount of invoice or invoices of 
same inclusive of Freight, Insurance and other charges, and ....per centj 
Commission, against shipment per steamer to— at the current rate; 
of exchange at 30 days’ sight and such Bill or Bills hereby bind ,;iEE, to, 
accept immediately on presentation and to pay at maturity with interest at the' 
rate of the Bank.' In the event of the goods arriving before the Bills become; 
due J, agree to retire the same under discount at the current rate of the Bank 
through which the documents are sent. 
If goods are ready for shipment on the contract terms and shut out, or 
have to wait for the steamer agree to accept them without raising any dispute;, 
goods to be accepted by the next aväilable steamer without allowances. w « further 
agree not to cancel goods nor to raise claim for late delivery if goods are, 
delivered 15 days after the stipulated time, and not to raise claim for early 
delivery if 15 days before. If goods are not ready for shipment on the contract 
terms w ' e shall be at liberty to cancel or to allow later shipment, but on no 
account shall .9, claim compensation for late delivery. In case goods are shipped 
late, have to state the refusal of same in writing within 3 days from receipt; 
of the Invoice; if fail to do so bound to accept the goods.
